These laws are designed to promote responsible ownership, prevent unauthorized access, and ensure that firearms are transferred, stored, and used safely. Who May Own a Firearm in California
California law restricts firearm ownership to individuals who meet strict eligibility requirements.
To legally own or possess a firearm in California, an individual must:
- Be 21 years of age or older for all firearm purchases
- Pass a background check through the Dealer Record of Sale (DROS) system
- Hold a valid Firearm Safety Certificate (FSC) unless exempt
State and federal law prohibit firearm ownership or possession by individuals who:
- Have felony convictions or certain violent misdemeanors.
- Are subject to domestic violence restraining orders or Gun Violence Restraining Orders (GVROs).
- Have been adjudicated as a danger to self or others or found mentally incompetent.
- Are prohibited due to certain mental health holds.
- Are addicted to narcotics.
Purchasing & Transferring Firearms
All firearm transactions in California must be processed through a licensed dealer.

- Background Check: All sales and transfers require a DROS background check.
- 10-Day Waiting Period: Firearms may not be released until the waiting period is complete.
- Safe Handling Demonstration: Buyers must demonstrate safe handling before taking possession.

Registration
All handguns and long guns transferred through a dealer are recorded in the state’s registry.
Assault weapons must have been registered during specific state authorized periods; unregistered possession is prohibited.

In the Home
Firearms must be stored:
- In a locked container,
- Or secured with a Department of Justice approved locking device,
- Or Kept under the owner’s immediate control
A firearm is considered “accessible” if a child or prohibited person could reasonably gain access — actual access is not required for liability.
In Vehicles
When left in an unattended vehicle, firearms must be:
- Unloaded, and
- Stored in a locked container or the vehicle trunk
Glove boxes and center consoles do not qualify as locked containers.
Prohibited Firearms & Equipment
California restricts or prohibits:
- Assault weapons (by model and by features)
- Large capacity magazines (over 10 rounds)
- Unserialized or “ghost” firearms
- Certain short barreled rifles, shotguns, and other restricted configurations
